CNN picks up the Christian Embassy video story
Campus Crusade owns Christian Embassy. The CNN segment is here; Did you see how Pastor John MacArthur did not get it at all? In his world view Christinas are better soldiers (he said it) and an authentic American is one who expresses his or her religious views anytime anywhere. Hopefully Mikey's lawsuits will wake them up. The thing that is most scary is the email Mikey gets from service men and women come not just from Jews and atheists but also from traditional Protestants and Catholics not only Jews or atheists. The Revered Melinda Morton also appears in the video, she was the first one to document the proselytizing at the Air Force Academy. She and Mikey are two heros. Here is a WaPo article about her. Now let's talk about my copyright infringement. As if Shockwave would violate the law! The Right Reverend Rabbi Judah says the following on his intriguing web site;
It seems the folks at Christian Embassy have gotten cold feet about proclaiming their faith in the Lord & Savior, because since this story broke, they removed this video from their website, put it back up with a disclaimer, then removed it again. They also, through their parent group, Campus Crusade for Christ, had YouTube remove it from my account. I've uploaded it to the site because the Lord & Savior wasn't afraid of a few lawsuits, so I don't see why Christian Embassy ought to be. For that matter, neither am I, since this use of copyrighted material is very clearly covered by Section 107, the Fair Use clause, of U.S. copyright law. Section 107 ehh!! You weak kneed YouTube!!!! So much for the "Man of the Year" Time mag award. So much for defending the little people. And the rule of law!
The 1961 Report of the Register of Copyrights on the General Revision of the U.S. Copyright Law cites examples of activities that courts have regarded as fair use: "quotation of excerpts in a review or criticism for purposes of illustration or comment; quotation of short passages in a scholarly or technical work, for illustration or clarification of the author's observations; use in a parody of some of the content of the work parodied; summary of an address or article, with brief quotations, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, in a newsreel or broadcast, of a work located in the scene of an event being reported." I claim "fair use" under Section 107.
This is the letter I got from YouTube/Google they did not bother to alert me or allow me to defend myself. What should I do? UPDATE: I placed my original Christian Embassy film cut at www.putfile.com since YouTube buckled under the pressure of the Campus Crusade people. Here Shockwave does not throw in the towel!
